General Information

1.1 These general terms and conditions (GTC) govern the relationship between Chocolaterie Martel and all its subsidiaries in Switzerland and abroad (hereinafter collectively referred to as “Chocolaterie Martel”) and its customers of the online store. They are an essential part of every contract concluded between Chocolaterie Martel and a customer. Any additional clauses, warranties, or modifications to these GTC must be made in writing. Therefore, these GTC apply to the ordering and delivery of standard items and special products from Chocolaterie Martel.

1.2 Additional information regarding delivery conditions, shipping costs, and payment terms, as well as texts for data protection and legal notices, are an integral part of these GTC and may be adapted at any time to new situations.

Conclusion of contract

The customer’s order is made online. The contract is concluded when Chocolaterie Martel sends the customer an order confirmation via email.

Modifications made to the order

The customer’s order is binding. After the customer has placed the order, they cannot make any modifications to it.

PRODUCTS CONTAINING ALCOHOL

In Switzerland and the European Union, the sale of products containing alcohol (wines, spirits, sparkling wines, etc.) is prohibited to those under 18 years of age. By placing an order in the Chocolaterie Martel online store, the customer agrees to this regulation and confirms that they are authorized to make purchases.

Delivery Conditions

5.1 The delivery of the ordered items is at the customer’s expense. Delivery, packaging, and shipping costs are separately indicated on the invoice. Packaging and shipping costs are detailed for domestic deliveries during the order process, and for international deliveries, they are shown before the completion of the order.
5.2 Deliveries in Switzerland and the Principality of Liechtenstein are made at an agreed time by delivery services freely appointed by Chocolaterie Martel.
5.3 Deliveries abroad are carried out by carriers chosen by Chocolaterie Martel. For shipments to warmer climate zones, insulating packaging is automatically used and charged to the customer.
5.4 In the case of impossible delivery or delays caused by incorrect delivery address details provided by the customer, the recipient’s absence, or customs issues, Chocolaterie Martel cannot be held responsible.
5.5 The estimated delivery times are provided for guidance only. Chocolaterie Martel cannot be held responsible for delivery delays beyond its control, such as force majeure, traffic jams, bad weather conditions, unusual and unexpected customs hold-ups, and such unforeseeable events do not entitle the customer to withdraw from the sales contract or claim compensation.

Price

6.1 The applicable prices are those indicated on the day the order is placed by the customer. The prices bind the parties until the order is confirmed by Chocolaterie Martel or for the duration indicated in the order confirmation. All prices are gross prices, unless otherwise stated, in Swiss francs (including VAT).
6.2 Price changes resulting from changes in taxes, tolls, fees, or shipping costs are reserved.

Payment Conditions

7.1 Orders in the online store must be paid by credit card. Credit card payments are charged immediately.
7.2 The ordered goods will be delivered only after payment is received.

Control of Goods / Claims

8.1 The recipient agrees to inspect the goods upon receipt to check if they are complete and in good condition. Any claims regarding quality and completeness must be communicated to Chocolaterie Martel immediately, but no later than 24 hours after delivery, otherwise the delivery will be considered accepted.
8.2 Chocolaterie Martel cannot be held responsible for damages occurring during transport or resulting from improper storage of the goods after receipt by the customer or their associates.

Return, Exchange, and Right of Withdrawal

9.1 The return or exchange of delivered products that are complete and intact is excluded. 9.2 Given the nature of all the products sold in the Martel online store, which are likely to deteriorate or expire quickly, any right of withdrawal for the customer or consumer is excluded.

Data Protection

10.1 The data necessary for the execution of transactions is recorded and, where applicable, retransmitted, as part of contract processing, to the companies responsible for execution. Furthermore, the recorded data is not transmitted to third-party companies, except for purposes of creditworthiness checks or, where applicable, debt collection services. The data is used within Chocolaterie Martel for maintaining customer relationships.
10.2 Correspondence regarding orders and other matters from Chocolaterie Martel may be conducted electronically. Attention is explicitly drawn to the security risks posed by the transmission of data via email, which is not under the control of Chocolaterie Martel, such as virus transmission, data damage and loss, or access by unauthorized third parties. By placing the order, the customer allows Chocolaterie Martel to send documents and other data via unencrypted emails

Applicable Law and Jurisdiction

11.1 Contracts are exclusively governed by Swiss law, excluding the Vienna Convention (CISG).
11.2 Geneva is the exclusive place of jurisdiction, subject to appeals before the Swiss Federal Court.

Monday – Thursday before 2 PM: delivery within 3 business days
Friday – Sunday: delivery on Tuesday/Wednesday
No delivery on Saturdays, Sundays, or public holidays; delivery occurs on the second business day. Delivery dates cannot be guaranteed.
Our recommendation:
If possible, place your order in advance, ideally 3 or 4 days before the desired delivery date. During holidays (Valentine’s Day, Easter, Mother’s Day, Christmas), parcel delivery times are generally longer.

1.3.2 Shipping Costs/Customs Duty Supplement
Shipping costs are calculated individually based on the destination (delivery zone), type of shipment, weight, and customs fees, and are therefore only displayed before placing the order.
For international deliveries by courier service, a customs duty will be charged in addition to shipping costs, based on a percentage of the merchandise value. This is calculated according to the applicable rates in each destination. The recipient of the goods will not incur additional costs.
