General

1.1
These general terms and conditions of sale (GTC) govern the relationship between Chocolaterie Martel with all its subsidiaries in Switzerland and abroad (hereinafter jointly referred to as “Chocolaterie Martel”) and its customers in the online store. They are an imperative element of each contract concluded between Chocolaterie Martel and a customer. Any ancillary clauses, assurances or amendments to these GTC must be in writing. These terms and conditions therefore apply to the ordering and delivery of standard and special products from Chocolaterie Martel.

1.2 Separate additional information on delivery conditions, shipping costs and payment conditions, as well as texts for data protection and legal notices, are an integral part of these GTC and can be adapted to new situations at any time.

Conclusion of a contract

The customer’s order is placed online. The contract is concluded when Chocolaterie Martel sends the customer an order confirmation by e-mail.

Changes to the order

The customer’s order is binding. After the customer has placed the order, he cannot make any changes to the order.

PRODUCTS CONTAINING ALCOHOL

In Switzerland and in the European Union, the sale of products containing alcohol (wine, spirits, sparkling wine, etc.) is forbidden to people under 18. By placing an order in the Chocolaterie Martel online store, the customer accepts these rules and confirms that he is authorized to make purchases.

Terms of delivery

5.1 The delivery of the ordered articles is at the expense of the customer. Delivery, packaging and shipping costs are indicated separately on the invoice. Packaging and shipping costs are detailed during the order process for domestic deliveries and before the order is placed for deliveries abroad.

5.2 Deliveries in Switzerland and the Principality of Liechtenstein are made at an agreed time by delivery services freely commissioned by Chocolaterie Martel.

5.3 Deliveries abroad are made by carriers chosen by Chocolaterie Martel. For shipment to warmer climates, insulating packaging is automatically used and charged to the customer.

5.4 In the event of impossible delivery or delay caused by incorrect data in the delivery address by the customer, the absence of the recipient or in the case of customs problems, Chocolaterie Martel cannot be held responsible.

5.5 The expected delivery times are given as an indication only. Chocolaterie Martel cannot be held responsible for delays in delivery beyond its control, for example in cases of force majeure, traffic jams, bad weather conditions, unusual and unexpected retentions by the customs authorities, and these imponderables do not authorize the customer to withdraw from the sales contract or to claim compensation.

Price

6.1 The applicable prices are those indicated on the day of the order placed by the customer. Prices are binding on the parties until confirmation of the order by Chocolaterie Martel or for the period indicated in the order confirmation. All prices are gross prices, unless otherwise stated, in Swiss francs (including VAT).

6.2 Price changes due to changes in taxes, tolls, fees, or shipping costs are reserved.

Terms of payment

7.1 Orders in the online store must be paid by credit card.
Credit card payments are charged immediately.

7.2 The ordered goods will be delivered only after receipt of payment.

Control of the goods / Complaints

8.1 The recipient undertakes to check the goods immediately upon receipt for completeness and good condition. Any complaints regarding quality and completeness must be communicated to Chocolaterie Martel immediately, but at the latest within 24 hours of delivery, otherwise the delivery will be considered accepted.

8.2 Chocolaterie Martel cannot be held responsible for damage occurring during transport or resulting from incorrect storage of the goods after receipt by the customer or his employees.

Return, exchange and right of withdrawal

9.1 The return or exchange of complete and undamaged products is excluded.

9.2 Given the nature of all products sold on the Martel online store, which are likely to deteriorate or expire quickly, any right of withdrawal for the customer or consumer is excluded.

Data protection

10.1 The data necessary for the execution of the transactions are stored and, if necessary, forwarded to the companies responsible for the execution of the contract. Incidentally, the recorded data is not passed on to third-party companies, except for the purposes of credit control or, if applicable, collection services. The data is used within Chocolaterie Martel for the purpose of maintaining customer relations.

10.2 Correspondence regarding orders and other matters from Chocolaterie Martel may be conducted by electronic means. Attention is explicitly drawn to the security risks involved in the transmission of data by e-mail which are not under the control of Chocolaterie Martel, such as the transmission of viruses, damage to and loss of data or access by unauthorized third parties. By placing the order, the customer allows Chocolaterie Martel to send documents and other data by means of unencrypted e-mails.

Applicable law and jurisdiction

11.1 Contracts are exclusively subject to Swiss law, to the exclusion of the Vienna Convention (CISG).

11.2 Geneva is the exclusive place of jurisdiction, subject to appeal to the Swiss Federal Court.

Monday – Thursday before 2pm: delivery within 3 working days Friday – Sunday: delivery Tuesday/Wednesday

No delivery on Saturdays, Sundays and holidays; delivery is made on the second working day. Delivery dates cannot be guaranteed.

Our recommendation:
If possible, place your order in time, if possible 3 or 4 days before the desired delivery date. Before the holidays (Valentine’s Day, Easter, Mother’s Day, Christmas), the delivery time for packages is usually a little longer.

1.3.2 Shipment Costs/Customs Free Supplement
The shipping costs are calculated individually according to the destination (delivery area), the type of shipment, the weight and the customs charges, and are therefore only indicated before the order is placed.
For deliveries abroad by courier service, a customs tax will be levied additionally at the customer’s expense as a percentage of the value of the goods. This is calculated according to the percentages in force in each destination. The receiver of the goods will not be subject to any additional costs.
